These Terms & Conditions ("Terms") govern your access to and use of the Property Select website, applications and services (the "Platform"), operated by [LEGAL ENTITY] ("Property Select", "we", "us"). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. What Property Select is — and is not
Property Select is an online intermediary and technology platform that connects buyers, sellers, owners, brokers and developers, and lists verified real-estate projects. We are an "intermediary" within the meaning of the Information Technology Act, 2000. We are not a party to any transaction between users, are not a real-estate agent, broker or advisor for such transactions, and do not guarantee the completion, terms, title, quality, legality or outcome of any transaction. Any agreement to buy, sell, lease or invest is solely between the concerned users.
2. Verification is a process, not a warranty
Our "5-step verification", RERA checks, capital-backing indicators and any scores, estimates, benchmarks or "nearby" information are provided on a good-faith, best-effort basis using available and third-party data (including public RERA records and mapping data). They are indicative aids, not warranties or professional advice. You must conduct your own independent due diligence, verify all facts (including title, approvals, RERA status, area, price and possession) and, where appropriate, obtain independent legal, financial and technical advice before making any decision.
3. No investment advice; no guaranteed returns
Information relating to the Property Select Fund (PSF), appreciation, rental yield, price trends or estimated value is for general information only and does not constitute investment, financial, legal or tax advice or a solicitation or guarantee of returns. Past performance is not indicative of future results. Real-estate investments carry risk. You are solely responsible for your decisions.
4. Listings and user content
Listings and content submitted by owners, brokers and developers are their responsibility. They warrant that they are authorised to list the property and to use all images and materials submitted, that the information is accurate, and that they do not infringe any third-party rights. Property Select may (but is not obliged to) review, verify, edit, re-categorise, unpublish or remove any listing or content at its discretion, including for inaccuracy, suspected fraud, or policy violation. You grant Property Select a worldwide, royalty-free licence to host, display, adapt and promote the content you submit for the purpose of operating and marketing the Platform.
5. Prohibited conduct
You must not: (a) post false, misleading, unlawful or infringing content; (b) scrape, copy, harvest or reuse the Platform's listings, data, images or compiled database except as expressly permitted; (c) upload content or images you are not authorised to use; (d) circumvent verification, fees, OTP, masking or security; (e) misuse contact details obtained via the Platform, including unsolicited spam; (f) impersonate others or interfere with the Platform's operation. Contact details and leads are provided for legitimate, one-to-one dealing only.
6. Intellectual property
The Platform, the "Property Select" name and marks, its design, software, text, compiled listings and database are owned by or licensed to Property Select and are protected by law. Except for content you own, you receive no right to use our intellectual property. Systematic extraction or reutilisation of our database is prohibited.
7. Fees, taxes and payments
Certain services (partner plans, featured boosts, contact reveals, exclusive mandates, verification services) are paid. Fees are as displayed at purchase, exclusive of applicable taxes (including GST) unless stated. Payments are processed by third-party gateways; we do not store full card details. Fees are governed by the Refund & Cancellation Policy.
8. Limitation of liability
To the maximum extent permitted by law, the Platform and all information are provided "as is" and "as available" without warranties of any kind. Property Select shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or opportunity, arising from your use of the Platform or any dealing between users. Property Select's total aggregate liability for any claim shall not exceed the amount of fees you paid to Property Select in the three (3) months preceding the event giving rise to the claim, or INR 5,000, whichever is lower. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Indemnity
You agree to indemnify and hold harmless Property Select, its affiliates, officers and employees from any claim, loss, liability or expense (including legal fees) arising from your content, your use of the Platform, your dealings with other users, or your breach of these Terms or applicable law.
10. Suspension and termination
We may suspend or terminate your access, or remove content, at any time for breach of these Terms, suspected unlawful activity, or to protect the Platform or other users.
11. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to the arbitration clause below, the courts at [CITY] shall have exclusive jurisdiction. Any dispute shall first be attempted to be resolved amicably; failing which it shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at [CITY], conducted in English.
12. Changes
